Your Consent to this Agreement

Please note that doing business with TAS Belize Limited means you have read, understand fully and agree to all our Business Policies and Design Process outlined below. Kindly click on thee ‘+’ icon to open up the related section.

STEP 1: GATHER IDEAS: Our team consults with the client to gather content, information, and ideas that would best express the client’s vision & brand. During this phase, we encourage clients to clearly communicate their expectations, while providing samples of the direction they want to take. We also conduct research on the client’s industry and best practices. Once a direction is agreed upon, we move to the design stage.

STEP 2: DESIGN: We create up to two (2) design proofs based on what was gathered. This usually takes three (3) to four (4) business days. For websites and brochures, from five (5) to eight (8) business days.

STEP 3: FEEDBACK STAGE: We send the proofs to the clients for review. The client’s feedback should be sent within 2 business days after proofs are received; unless arrangements are made otherwise. The client then decides which proof to go with or requests changes. If no direction is liked, we communicate and together decide on what new direction to move forward in. * After three (3) complete proof changes, extra charges will apply.

STEP 4: SEND APPROVED DESIGN: Once the changes are made and approved, the high-quality files are packaged and sent to the client. Formats sent are JPEG, PNG & PDF.

*Only approved proof can be used publicly. The additional design proof sent cannot be used without the approved permission of TAS Belize Limited.

STEP 4: SATISFIED CLIENT: TAS Belize is pleased when our clients are satisfied with our work.

Definitions 

  • Proofs – a preliminary version of a final piece 

Prices may vary depending on what service is requested. TAS Belize reserve the right to change prices at any given time for any given purpose.

Payment for services entitles the client to a copy of the approved end product in the following appropriate formats upon request: JPEG, PNG, PDF, TIFF, AVI, MP4, MOV, WAV, MP3, FLAC, etc. All formats are “As a copy” and not layered.

The client is NOT paying for the  Photoshop/ Indesign/ Illustrator design files, Audition/Cubase tracks, Premiere/ Final  Cut sequence files, After effect template, fonts, raw elements,  raw video footage, etc that make up the source files.

If clients would like a copy of the source files, they can purchase it separately. Kindly contact us to make requests.

After a job is approved you will receive your product in the formats agreed to (mentioned above). If there are any errors that need to be corrected (for example with spelling or content error) those changes will be made free of charge. If any major design changes are required after a design is approved, there will be an extra service fee charge.

TAS Belize adds the final approved end product/design to its portfolio. If for some reason you feel it best that your design not be added (for example sensitive content) please contact us.

Unless stated otherwise, the following payment schedule is in effect for all branding & graphic design solutions, video production, and audio production work. All services will require a fifty percent (50%) down payment before the job is started. A 25% payment of the total price is required when the first draft is delivered to the client. The final 25% percent payment is due BEFORE TAS Belize hands over the high-quality version of the approved work.

All projects are billed based on an agreed timeframe of completion. If the project exceeds the agreed timeframe due to The Client:

  • failure to provide content in a timely manner;
  • failure to provide feedback on the work provided within the agreed timeframe

a 20% extension fee will be applied to the total cost of the project.

For website development & online services, payment schedules are outlined in the signed agreements and vary depending on the scope of the project.

When is a payment late and subject to penalties? A late fee of two percent (2%) of the total is due every month that the balance remains unpaid.

Charges will be applied directly to all accounts where payments are made five [5] calendar days after the due date.

We encourage all our customers to make payments on time to avoid additional charges to their accounts. We kindly remind our customers of the following:

  • Ensure that the amount paid is not less than the required amount.
  • If paying through a bank [over the counter or online], ensure that your payment is made no later than the agreed payment date so that your payment is applied to your TAS account on time. Please note: payments made through the banks are received by the TAS on the next working day.
  • For bank payments, we encourage you to kindly forward a copy of the deposit slip to accounts@tasbelize.com to ensure that your payment is applied accordingly.

Content is any text, photo, video, and/or digital file given to TAS Belize by the client. TAS Belize adds sent information/content as is. Although spell check is used as standard practice, it can only go so far. TAS Belize trusts you are giving in exactly what you want on your product unless advised otherwise.

If any error on an approved product gets printed, TAS Belize will not be held responsible for any damages due to spelling or grammar on approved designs that are printed. Please help to ensure that the content sent in and the end product are 100% accurate.

If a job is cancelled before it is started you will get a full refund (if transaction fee is required it will be paid out of the amount paid). If a job is cancelled after the job has a been started, a 50% of the job cost will be charged. No refunds for jobs that have gone through several drafts (2 or more).

In the event that goods or products are being procured through TAS Belize, a seventy-five percent (75%) deposit is required before order is placed. The balance is due upon delivery of the item. There are no exceptions to this service.

TAS Belize Limited will provide the initial draft concepts to the Client within the time frame agreed upon in the initial consultation. Please note that if we are experiencing higher than usual demand, your product will be scheduled for the next available time slot and you will be notified at the earliest possible time.

TAS Belize Limited will post the initial draft in an email or to a web site for review by the Client. The Client will then be able to view his/her draft product and also be able to provide feedback concerning the product.

TAS Belize Limited will analize the Client’s feedback and revise the product. The revised samples will be presented to the Client within the specified timeframe.

Regular working days are Monday through Friday, 9am – 5pm, excluding Belizean holidays.

TAS Belize Limited will continue the revision process as per the terms of the specific contract, until Client is satisfied. Once the Client has approved the final product, the Client will complete any remaining payment owed, and TAS Belize Limited will then proceed with the delivery phase.

All requested formats of the approved product are then emailed or posted to the client download area for the Clients use.

The Client unconditionally guarantees that any element of text or graphics furnished to TAS Belize Limited in the product do not infringe on any copyright or trademarks that have been already established by another company or organization.

The Client will hold harmless and protect TAS Belize Limited from any claim or suit arising from the use of such as furnished by the client.

TAS Belize Limited makes every effort to produce original artwork. If, however, we create products for you which accidentally infringes on any existing trademarked artwork, TAS Belize Limited holds no liability and is limited only to a refund of the paid amount.

TAS Belize Limited will do no research checking on the legal availability of the name we are creating products for. It is the Client’s responsibility to ensure that the name of their product, company or service is not already in use, and it is the Client’s sole responsibility to secure a service mark or trademark to protect the rights to any name or image.

TAS Belize Limited and its employees will not be held responsible for any legal action that may result from improper due diligence on the availability of a company name or image.

Concepts are also the ownership of TAS Belize Limited regardless of product type. Until the contract is paid in full, all materials remain property of TAS Belize Limited.

TAS Belize Limited retains the right to display the artwork in their corporate portfolios and marketing materials.

All concepts furnished to the client are for client review and comment purposes only. TAS Belize Limited retains exclusive copyright and ownership of all products and draft materials.

All draft concepts previewed by the client are for client review and comment purposes only.

TAS Belize Limited reserves the right to utilize and/or reproduce any image, logo or illustration, audio, beat, video, web content created by TAS Belize Limited in advertising, electronic or traditional reproduction, with the addition of any copyright and/or trademark notice that may be requested by the owner of the work. The client is granted unlimited royalty-free use of the image upon full payment of all fees.

TAS Belize Limited retains the rights to concepts, comprehensives and all product involved in the production process prior to the final delivery, and is granted the right to use these products in promotional and advertising and marketing materials.

Revisions may be discussed verbally, however no work will be done until the Client submits their revisions in writing, by email. The Client understands that revision work, along with requests for project additions or author alterations, will incur the same hourly billable as noted in the project quotation.

Revision work is not done free of charge unless otherwise arranged, in writing or in the package agreed to in advance. If a base package is agreed upon, however the revisions and requests exceed this package parameters, the next Client will be notified in advance.

The quotation assumes a reasonable average number of revisions per product as outlined in the package, but on very rare occasion a project arises in which the Client requests an unusually large number of drafts or revisions. Any and all revisions will still incur the hourly rate as noted on the project quotation, and the Client confirms that any revisions or additions they request will incur this cost.

TAS Belize Limited can and may provide information to the Client about print solutions that complement the projects needs to the best knowledge of the Company. TAS Belize Limited is not responsible for price discrepancies advertised by third party companies. This includes product specifications, rush order and special order pricing, and delivery costs associated.

TAS Belize Limited is not responsible for a third company’s failure to deliver in the parameters set out by said company. This includes delivery time; product availability; print error; damage incurred due to shipping; and other unforeseen issues.

All concerns can and will be expressed by the Company to the third company association, but are not responsible and take no fault for failure to deliver on consented parameters. Payment must be made for said project and may not be withheld because of printer error.

If there has been no activity initiated by the client on a contract in 30 days, but the client has been responsive to status requests by the project manager, said contract will be classified as “inactive”. Inactive contracts are invoiced periodically throughout the fiscal year, to ensure all parties are able to keep their records up-to-date. Please note that an inactive classification has no adverse effect on your account, provided all invoices are paid on time. If your project is incomplete and you have received an inactive project invoice, please rest assured that you are being invoiced only for work actually completed to date, and that you are welcome to.

re-open the project at any time. Upon payment of your invoice, you will have rights to request delivery of any project (complete, or otherwise). Any credits (hourly or otherwise) granted to the client’s account are valid and redeemable at any time pending TAS Belize Limited’s availability, until a period of six months has passed, at which point all credits are considered null and expired.

After 30 days, a late payment charge of 2% per month is applied to all delinquent accounts, without exception and retroactive to the date of invoice. If the account remains in default after 60 days, or if the customer’s payment is charged back to us by way of cheque fraud or other crime, we will issue one final notice before turning the account over to a third-party collections agency. Late fees will continue to accrue on your account, and you will be responsible for all costs incurred for placing you in collections. Refusing to pay your bill is theft, and we take it very seriously. If collection efforts are unsuccessful, we will engage the client in litigation to collect the debt, and all copyright will revert to TAS Belize Limited.  The client will have no rights to use the materials in any way, shape or form, and legal action will be taken to enforce this policy.

If a client should abandon a project or contract after work has commenced, an invoice shall be issued for the full quoted amount, regardless of project status on abandonment. Abandoned contracts in cases where the client is unresponsive are also subject to an accelerated collections policy, and will be submitted to a third-party collections agency if not paid or addressed within 30 days.

Designs, original art, clip art and projects presented by TAS Belize Limited are for the use of the authorized client. All art, images, designs, and material are copyright of TAS Belize Limited and may not be resold, added to clipart collections or any other unauthorized form of distribution or reproduction without the express written permission of TAS Belize Limited and the images contained within.

By using the TAS Belize Limited website and/or engaging in business with TAS Belize Limited, you consent to the terms specified above. We reserve the right to modify this policy. If we do change our Privacy Policy, we will post those changes on this page so that you are always aware of what information we collect, how we use it, and under what circumstances we disclose it.

TAS Belize Limited reserves the right to amend these terms at any time. Should it happen that a client’s own terms and conditions conflict with any of the same set out on this page, this document shall be considered to be the authoritative one, unless a separate contract has been signed by the client and by an authorized agent of TAS Belize Limited.
